1. Acceptance of Terms
By accessing or using Graphora ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
Graphora is a note-taking and knowledge management application that provides bi-directional linking, visual knowledge graphs, collaborative shared spaces, and cloud synchronization across devices.
3. Account Responsibilities
- You must provide accurate information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You must notify us immediately if you suspect unauthorized access to your account.
- You must be at least 16 years of age to use the Service.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe on the intellectual property rights of others
- Upload malicious code or attempt to compromise the Service
- Harass, abuse, or harm other users, including through shared spaces
- Use automated tools to scrape or extract data from the Service without permission
- Attempt to gain unauthorized access to other users' data
5. Intellectual Property
Your content is yours. You retain all rights to the notes, documents, and knowledge graphs you create using Graphora. By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you.
The Graphora name, logo, and application design are our intellectual property and may not be used without our written permission.
6. Shared Spaces and Collaboration
When you share content in a collaborative space, other members of that space can view and, depending on permissions, edit that content. You are responsible for the content you share and should only share content you have the right to distribute.
7. Service Availability
We strive to keep Graphora available and reliable, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime.
8. Limitation of Liability
To the maximum extent permitted by law, Graphora and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising from your use of the Service.
Our total liability for any claim related to the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.
9. Termination
You may delete your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your right to use the Service ceases immediately. We will make your data available for export for a reasonable period following termination, except in cases of serious violations.
10. Changes to These Terms
We may update these Terms of Service from time to time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the updated terms.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany. Any disputes arising from these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts in Berlin, Germany.
